These Terms of Service (“Terms”) govern your access to and use of PULSE websites, applications, and related services. By using PULSE, you agree to these Terms. If you do not agree, do not use the service.
Eligibility and accounts
You must be old enough to enter a binding contract in your jurisdiction to use PULSE on your own behalf. If you use PULSE on behalf of a gym, team, or employer, you represent that you have authority to bind that organization.
You are responsible for maintaining the confidentiality of your credentials and for activity that occurs under your account. Notify us promptly if you suspect unauthorized access.
The service
PULSE provides tools for programming, logging, coach communication, and related training workflows. Features may vary by plan, region, or early-access program.
We may modify, suspend, or discontinue parts of the service with reasonable notice where practicable. We are not responsible for third-party services or content you link to from PULSE.
Acceptable use
You agree not to misuse PULSE. Without limitation, you must not: attempt to gain unauthorized access to systems or data; interfere with the integrity or performance of the service; use the service to harass others; upload malware; scrape the service in violation of our technical policies; or use the service in violation of law.
We may investigate violations and suspend or terminate accounts where we reasonably believe a violation has occurred.
Your content and license to us
You retain ownership of content you submit to PULSE (such as training notes, videos, and messages). You grant PULSE a worldwide, non-exclusive license to host, process, transmit, display, and create backups of your content solely to operate, secure, and improve the service for you and your organization.
You are responsible for ensuring you have the rights to upload content and that content does not infringe third-party rights.
Fees, trials, and taxes
Paid plans, trials, renewals, and refunds are described at checkout and in plan-specific terms presented before you pay. Unless stated otherwise, fees are billed in advance and are non-refundable except where required by law or explicitly stated in writing.
Taxes may be added based on your billing address. If payment fails, we may suspend access until payment succeeds.
Disclaimers
PULSE provides software and information tools. It is not a substitute for professional medical advice. Consult qualified professionals before starting or changing an exercise program, especially if you have health conditions.
EXCEPT WHERE PROHIBITED BY LAW, THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, PULSE AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AND SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, OR ANY LOSS OF PROFITS, GOODWILL, OR DATA, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, OUR AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE IN ANY TWELVE-MONTH PERIOD IS LIMITED TO THE GREATER OF ONE HUNDRED US DOLLARS (US $100) OR THE AMOUNTS YOU PAID PULSE FOR THE SERVICE DURING THAT PERIOD.
Some jurisdictions do not allow certain limitations; in those cases, our liability is limited to the fullest extent permitted by law.
Indemnity
To the extent permitted by law, you will defend and indemnify PULSE and its affiliates against any claims, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of your content, your use of the service in violation of these Terms, or your violation of law or third-party rights.
Governing law and disputes
These Terms are governed by the laws designated in your order form or, if none is stated, by the laws of the jurisdiction where the contracting PULSE entity is organized, excluding conflict-of-law rules.
Some regions give you the right to bring disputes in local courts or through mandatory consumer arbitration schemes. Nothing in these Terms limits rights you cannot waive by contract.
Changes
We may update these Terms from time to time. We will post the updated Terms on this page and update the “Last updated” date. If changes are material, we will provide additional notice as appropriate. Continued use after the effective date constitutes acceptance of the updated Terms.
